Right of withdrawal, returns and exchanges
This policy sets out the conditions for returns, withdrawal and exchanges for purchases made on cronospharma.com from CRONOS PHARMA İLAÇLARI SANAYİ VE TİCARET A.Ş. ("Cronos Pharma"), in accordance with the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts. It applies to consumers who buy products directly from Cronos Pharma on cronospharma.com for non-commercial, non-professional purposes; withdrawal and return requests for products bought from pharmacies or other retailers should be directed to the respective seller. The detailed terms of your order are set out in the Preliminary Information Form and the Distance Sales Contract you accept when ordering. In case of any discrepancy, the Turkish version prevails.
You may withdraw from the contract within 14 days of the delivery of the goods to you or to a third party you have designated, without giving any reason and without paying any penalty. If several goods ordered together are delivered separately, the period starts on the delivery of the last item. It is sufficient to send the withdrawal notice within this period.
You may also exercise your right of withdrawal at any time between the confirmation of your order and the delivery of the product; it is sufficient to notify us by one of the means listed in section 3. If the product has not yet been shipped, your order is cancelled; if it has already been shipped, you do not need to accept the parcel and it will be returned to us at no cost to you. In either case, all payments collected are refunded as described in section 4 within 14 days of the date your notice reaches us.
Under Article 15 of the Regulation on Distance Contracts, the right of withdrawal does not apply to goods whose protective elements such as packaging, tape, seal or wrapping have been opened after delivery and whose return is not suitable for health and hygiene reasons. Accordingly:
This exception does not affect your rights regarding defective, damaged or incorrect products (section 5).
Payments on cronospharma.com are made by credit or debit card. All payments collected, including delivery charges, are refunded in a single payment and at no cost to you, within 14 days of the date your withdrawal notice reaches us, to the card used for the payment:
You may also withdraw from only part of your order; in that case the price you paid for the returned products is refunded, and if you withdraw from the entire order, the delivery charge is also refunded. For products bought at a discount or under a promotion, the refund amount is the price you actually paid for that product after discounts.
For defective, damaged or incorrectly delivered products, the product is replaced free of charge with a non-defective equivalent if you choose so; you may instead use the other statutory rights listed in section 5. If you simply wish to change a non-defective product, you can return it by exercising your right of withdrawal, provided its protective seal has not been opened, and place a new order.
Orders are shipped with Yurtiçi Kargo to the delivery address you provide, within the period stated in the order summary and in any case within the statutory maximum of 30 days from the order date. If the product is not delivered within this period, you may terminate the contract; in that case all payments collected, including delivery charges, are refunded to you in a single payment and at no cost within 14 days of the date your termination notice reaches us. If it becomes impossible to fulfil your order, we will notify you in writing or by e-mail within 3 days of learning of this and refund all payments collected within 14 days of that notice at the latest.
For complaints and objections, you may apply to the consumer arbitration committee (Tüketici Hakem Heyeti) at your place of residence or where the consumer transaction was made for disputes below the monetary limit announced each year by the Ministry of Trade; applications can also be made via e-Devlet. For disputes above this limit you may file a lawsuit before the consumer court; however, except for the cases listed in the Law, applying to a mediator before filing a lawsuit is mandatory (Article 73/A of Law No. 6502). A lawsuit may also be filed at the consumer court of your place of residence.
